Minor Guardianship

Probate courts have jurisdiction over the appointment and supervision of guardians and conservators of minors. 

  • Minor MUST be in the physical custody of the petitioner, residing in Banks County when petition is filed.
  • Temporary guardians are appointed for minors where one or both natural parents are still living, and with notice and/or consent of both natural parents. 
  • Permanent guardians are appointed for minors when both parents are deceased or parental rights have been terminated by a Court.
  • Conservatorship of property of child under the age of 18  is required when such property is valued at over $15,000.00.
  • Nominated guardians and/or conservators must submit to a criminal background check.
  • Annual Status Reports are filed by guardians.
  • Annual Financial Accountings are filed by conservators, which are subject to review or audit by the staff of the probate court.
  • Appointed conservators will be required to post a surety bond.V
